Our offers are aimed exclusively at entrepreneurs within the meaning of \u00a7 14 BGB (German Civil Code). These General Terms and Conditions of CHM Work Base govern the contractual relationship between CHM Work Base UG (haftungsbeschr\u00e4nkt) and its customers (hereinafter also referred to as \u201etenant\u201c or \"you\"). The following General Terms and Conditions apply exclusively to the business relationship with you in the version valid at the time the contract is concluded. Deviating general terms and conditions of you will not be recognised unless we expressly agree to their validity in writing.\u00a0<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1. conclusion of the contract \u00a0<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">After the tenant has made a booking enquiry, e.g. by telephone, email or via the contact form on our website, we will send the tenant offers of accommodation to rent in response to their enquiry, usually by email. Our offers constitute an offer to conclude a contract. A contract is only concluded upon the tenant's booking confirmation by WhatsApp or email as acceptance of the contract.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2. arrival\/departure\/house or flat type &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Unless expressly agreed otherwise, the rental property is available from 4 pm on the day of arrival and must be vacated by 10 am at the latest on the day of departure.\u00a0<\/li>\n\n\n\n<li>Unless expressly agreed otherwise, the booking refers exclusively to the type of flat or accommodation booked. There is no entitlement to a specific flat or room.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">3. terms of payment, rent, deposit &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The rent must be paid in full before the rental property is handed over. The tenant has no claim to the handover of the rented property before the rent has been paid in full.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">The agreed rent is due immediately upon conclusion of the contract and must be paid in full within one week of receipt of the invoice. If the booking is made less than one week before arrival, the full rent must be paid on the day after receipt of the invoice. The date of receipt of payment in our account is decisive.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the lessee fails to make payment on time and we set a reasonable grace period without receiving full payment, we shall be entitled to withdraw from the contract.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Consumption costs (electricity, water and gas) are included in the rent, unless otherwise agreed.\u00a0<\/li>\n\n\n\n<li>If agreed with the tenant, the latter is obliged to pay a deposit or a key deposit in the agreed amount before handing over the rented property.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">4. cancellation\/termination for good cause &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If the tenant wishes to cancel the booking before arrival, this must be done in writing (e-mail to info@chm-workbase.de is sufficient). The tenant will incur the following costs:\u00a0<ul><li>Cancellations can be made free of charge up to 30 days before the agreed arrival date.\u00a0<\/li><\/ul><ul><li>From 29 days before the agreed arrival date, 30 % of the total rent will be charged.\u00a0<\/li><\/ul><ul><li>From 14 days before the agreed arrival date, 75 % of the total rent will be charged.\u00a0<\/li><\/ul><ul><li>From 10 days before the agreed arrival date, 100 % of the total rent will be charged.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>In the event of cancellation or termination on the day of arrival or in the event of a no-show, 100 % of the total rent will be charged.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Decisive for the time of cancellation is the receipt of the cancellation notice by us.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of a partial cancellation, the total rent refers to the rent due for the cancelled period.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Booking changes are only permitted with our consent.\u00a0<\/li>\n\n\n\n<li>The right of cancellation for good cause remains unaffected for both contracting parties.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Good cause entitling us to terminate the contract without notice exists in particular in the event of use of the rented property and the inventory in breach of the contract, subletting, additional occupancy and serious disturbance of the peace of the house.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the event of cancellation by us for good cause, we expressly reserve the right to claim further damages. The lessee reserves the right to prove that less damage or no damage at all has been incurred.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">5 Obligations of the tenant &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The information provided in the booking enquiry must be entered conscientiously and truthfully.\u00a0<\/li>\n\n\n\n<li>You are obliged to treat the rented property and the inventory with care. Furnishings may not be removed from the rented property, not even temporarily.\u00a0<\/li>\n\n\n\n<li>If you discover any damage or defects in the rental property on arrival, you must inform us immediately. The tenant is liable for any damage caused to the rental property or missing inventory during the rental period.\u00a0<\/li>\n\n\n\n<li>The rental property may only be occupied by the number of persons requested in the booking (or, if different, the agreed number of persons).\u00a0<\/li>\n\n\n\n<li>The rented property must be left swept clean by the tenant, i.e. you must remove any coarse soiling. In particular, the following must be done:\u00a0<ul><li>Vacuuming carpets\u00a0<\/li><\/ul><ul><li>Sweeping smooth floors\u00a0<\/li><\/ul><ul><li>Remove coarse dirt in the kitchen and sanitary facilities, including limescale deposits.\u00a0<\/li><\/ul><ul><li>All objects that you have brought into the rented property must be removed.\u00a0<\/li><\/ul><ul><li>The crockery must be clean and tidy.\u00a0<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>The rubbish must be disposed of.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">If you do not fulfil this obligation, you will be charged an hourly rate of EUR 100 for the work involved in making the property swept clean.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>You are not authorised to sublet the rental property without our consent.\u00a0<\/li>\n\n\n\n<li>Smoking is not permitted in the rental property, not even at the window. In the event of non-compliance, we will charge you an amount of EUR 200 for the special cleaning of the rental property. You are entitled to prove that no damage or a reduction in value has occurred or that it is significantly lower than the aforementioned flat rate.\u00a0<\/li>\n\n\n\n<li>They must show consideration for their neighbours. A quiet night must be observed between 10.00 pm and 6.00 am. If house rules apply to the rented property and these are made known to you (e.g. by a notice in the rented property or in the hallway), you must comply with the house rules.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">6. pets &nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Pets are only permitted in the rental property with our express consent.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">7. internet use &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If Wi-Fi is available in the rental property, the use of the Internet is free of charge for the tenant with their own device. We do not guarantee constant availability, compatibility and security.\u00a0<\/li>\n\n\n\n<li>In any case, any use of the WLAN that is likely to impair the interests of CHM Work Base is prohibited. The interests of CHM Work Base shall be deemed to be impaired in particular if legal provisions are violated.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In particular, but not limited to, the following are not permitted:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Retrieving, offering, distributing or storing content that violates personal rights, copyright law, data protection law or criminal law;\u00a0<ul><li>Retrieving, offering, distributing or storing computer viruses or other malware as well as other activities that are directed against the security of IT systems (e.g. hacking, port scans);\u00a0<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>Retrieval of content that is subject to a charge for the CHM Work Base.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">8. final provisions &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any amendment or addition to these agreements must be made in writing, whereby e-mail is sufficient. This also applies to any cancellation of the written form requirement.\u00a0<\/li>\n\n\n\n<li>The contractual relationship is subject exclusively to German law. Ludwigshafen am Rhein is agreed as the exclusive place of jurisdiction.\u00a0<\/li>\n\n\n\n<li>Should individual provisions be or become invalid or unenforceable for any reason, this invalidity or unenforceability shall not affect or impair the legal validity of the remaining provisions. The same applies if it should transpire that<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">the contract contains a loophole.
