Na\u0161e ponude usmjerene su isklju\u010divo na poduze\u0107a kako je definirano u \u010dlanku 14. njema\u010dkog gra\u0111anskog zakonika (BGB). Ovi Op\u0107i uvjeti poslovanja CHM Work Base ure\u0111uju ugovorni odnos izme\u0111u CHM Work Base UG (ograni\u010dena odgovornost) i njegovih kupaca (u daljnjem tekstu i &quot;najmoprimac&quot; ili &quot;vi&quot;). Sljede\u0107i Op\u0107i uvjeti poslovanja, u verziji va\u017ee\u0107oj u trenutku sklapanja ugovora, primjenjuju se isklju\u010divo na poslovni odnos s vama. Va\u0161i druga\u010diji uvjeti poslovanja ne\u0107e se priznati osim ako izri\u010dito pismeno ne pristanemo na njihovu valjanost.\u00a0<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">1. Zaklju\u010divanje ugovora \u00a0<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Nakon \u0161to najmoprimac po\u0161alje zahtjev za rezervaciju, npr. telefonom, e-po\u0161tom ili putem kontakt obrasca na na\u0161oj web stranici, poslat \u0107emo najmoprimcu ponude za raspolo\u017eive smje\u0161taje kao odgovor na njegov zahtjev, obi\u010dno e-po\u0161tom. Na\u0161e ponude predstavljaju ponudu za sklapanje ugovora. Ugovor se sklapa tek nakon \u0161to najmoprimac potvrdi rezervaciju putem WhatsAppa ili e-po\u0161te, \u010dime prihva\u0107a ponudu.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">2. Dolazak\/Odlazak\/Vrsta ku\u0107e ili apartmana &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Osim ako nije izri\u010dito druga\u010dije dogovoreno, nekretnina za najam dostupna je od 16 sati na dan dolaska i mora se napustiti do 10 sati na dan odlaska.\u00a0<\/li>\n\n\n\n<li>Osim ako nije izri\u010dito druga\u010dije dogovoreno, rezervacija se odnosi isklju\u010divo na rezervirani apartman ili vrstu smje\u0161taja. Ne postoji pravo na odre\u0111eni apartman ili sobu.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">3. Uvjeti pla\u0107anja, najamnina, polog &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Najamnina mora biti pla\u0107ena u cijelosti prije predaje nekretnine za najam. Najmoprimac nema pravo preuzeti posjed nekretnine za najam dok se najamnina ne plati u cijelosti.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Dogovorena najamnina dospijeva odmah po sklapanju ugovora i mora se u cijelosti platiti u roku od tjedan dana od primitka ra\u010duna. Ako se rezervacija izvr\u0161i manje od tjedan dana prije dolaska, puna najamnina dospijeva dan nakon primitka ra\u010duna. Datum primitka uplate na na\u0161 ra\u010dun je odlu\u010duju\u0107i u svakom slu\u010daju.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ako najmoprimac ne izvr\u0161i pla\u0107anja na vrijeme, a mi ne uspijemo odrediti razumno razdoblje odgode pla\u0107anja bez primitka pune uplate, imamo pravo odustati od ugovora.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tro\u0161kovi re\u017eija (struja, voda i plin) uklju\u010deni su u cijenu najma, osim ako nije druga\u010dije dogovoreno.\u00a0<\/li>\n\n\n\n<li>Ako je s najmoprimcem dogovoreno, najmoprimac je du\u017ean platiti polog ili depozit za klju\u010d u dogovorenom iznosu prije primopredaje nekretnine za najam.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">4. Otkazivanje\/raskid iz opravdanog razloga &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ako najmoprimac \u017eeli otkazati rezervaciju prije dolaska, to mora u\u010diniti pismeno (dovoljno je poslati e-po\u0161tu na info@chm-workbase.de). Najmoprimac \u0107e snositi sljede\u0107e tro\u0161kove:\u00a0<ul><li>Otkazivanje rezervacije mogu\u0107e je besplatno do 30 dana prije dogovorenog datuma dolaska.\u00a0<\/li><\/ul><ul><li>Od 29 dana prije dogovorenog datuma dolaska, napla\u0107uje se 30 % od ukupne najamnine.\u00a0<\/li><\/ul><ul><li>Od 14 dana prije dogovorenog datuma dolaska, napla\u0107uje se 75 % od ukupne najamnine.\u00a0<\/li><\/ul><ul><li>Od 10 dana prije dogovorenog datuma dolaska, napla\u0107uje se 100 % od ukupne najamnine.<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>U slu\u010daju otkazivanja ili raskida na dan dolaska ili u slu\u010daju nedolaska, napla\u0107uje se 100 % od ukupne cijene najma.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Odlu\u010duju\u0107i faktor za vrijeme otkazivanja je primitak obavijesti o otkazivanju od strane nas.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U slu\u010daju djelomi\u010dnog otkazivanja, ukupna najamnina odnosi se na najamninu koja se ne pla\u0107a za otkazano razdoblje.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Promjene rezervacije su dopu\u0161tene samo uz na\u0161 pristanak.\u00a0<\/li>\n\n\n\n<li>Pravo na raskid ugovora iz opravdanog razloga ostaje nepromijenjeno za obje ugovorne strane.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Va\u017ean razlog koji nam daje pravo na raskid ugovora bez prethodne najave postoji posebno u slu\u010daju kori\u0161tenja iznajmljene nekretnine i inventara suprotno ugovoru, podnajmljivanja, prekomjerne popunjenosti i ozbiljnog reme\u0107enja javnog reda i mira.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U slu\u010daju raskida ugovora s na\u0161e strane iz opravdanog razloga, izri\u010dito zadr\u017eavamo pravo tra\u017eiti dodatnu naknadu \u0161tete. Najmoprimac zadr\u017eava pravo dokazati da je nastala manja ili nikakva \u0161teta.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">5. Obveze najmoprimca &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Prilikom podno\u0161enja zahtjeva za rezervaciju, navedene podatke treba unijeti pa\u017eljivo i istinito.\u00a0<\/li>\n\n\n\n<li>Najmoprimci su du\u017eni pa\u017eljivo postupati s nekretninom za najam i njezinim sadr\u017eajem. Namje\u0161taj se ne smije uklanjati iz nekretnine za najam, \u010dak ni privremeno.\u00a0<\/li>\n\n\n\n<li>Ako po dolasku otkrijete bilo kakvu \u0161tetu ili nedostatke na nekretnini za najam, morate nas odmah obavijestiti. Najmoprimac je odgovoran za svaku \u0161tetu na nekretnini za najam ili nedostatak inventara koji nastane tijekom razdoblja najma.\u00a0<\/li>\n\n\n\n<li>Nekretninu za najam smije koristiti samo broj osoba zatra\u017een tijekom postupka rezervacije (ili, ako je druga\u010diji, dogovoreni broj).\u00a0<\/li>\n\n\n\n<li>Najmoprimac mora ostaviti nekretninu za najam \u010distom, \u0161to zna\u010di da morate ukloniti svu ve\u0107u prljav\u0161tinu ili krhotine. Posebno se mora u\u010diniti sljede\u0107e:\u00a0<ul><li>Usisavanje tepiha\u00a0<\/li><\/ul><ul><li>Metenje glatkih podova\u00a0<\/li><\/ul><ul><li>Uklonite grubu prljav\u0161tinu iz kuhinje i sanitarnih \u010dvorova, uklju\u010duju\u0107i naslage kamenca.\u00a0<\/li><\/ul><ul><li>Sve stvari koje ste unijeli u iznajmljeni prostor moraju se ukloniti.\u00a0<\/li><\/ul><ul><li>Posu\u0111e mora biti \u010disto i pospremljeno.\u00a0<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>Sme\u0107e se mora zbrinuti.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ako ne ispunite ovu obvezu, naplatit \u0107e vam se satnica od 100 eura za rad potreban za dovo\u0111enje prostorija u stanje \u010disto\u0107e.&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Nemate pravo iznajmiti nekretninu za najam bez na\u0161eg pristanka.\u00a0<\/li>\n\n\n\n<li>Pu\u0161enje nije dopu\u0161teno u iznajmljenom objektu, uklju\u010duju\u0107i i na prozorima. U slu\u010daju kr\u0161enja, naplatit \u0107emo vam naknadu od 200 EUR za posebno \u010di\u0161\u0107enje iznajmljenog objekta. Dopu\u0161teno vam je dokazati da nije nastala \u0161teta ili gubitak vrijednosti ili da je znatno manji od gore navedene pau\u0161alne naknade.\u00a0<\/li>\n\n\n\n<li>Najmoprimci moraju biti obzirni prema svojim susjedima. Mirno vrijeme mora se po\u0161tivati izme\u0111u 22:00 i 6:00 sati. Ako se na nekretninu za najam primjenjuju ku\u0107ni redovi i ako su vam s njima obavije\u0161teni (npr. objavljivanjem u zgradi ili hodniku), morate ih se pridr\u017eavati.\u00a0<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">6. Ku\u0107ni ljubimci &nbsp;<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">Ku\u0107ni ljubimci su dozvoljeni u iznajmljenom objektu samo uz na\u0161 izri\u010dit pristanak.&nbsp;<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">7. Kori\u0161tenje interneta &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Ako je u iznajmljenom objektu dostupan Wi-Fi, kori\u0161tenje interneta je besplatno za najmoprimca s vlastitim ure\u0111ajem. Ne jam\u010dimo kontinuiranu dostupnost, kompatibilnost ili sigurnost.\u00a0<\/li>\n\n\n\n<li>Strogo je zabranjeno svako kori\u0161tenje Wi-Fi mre\u017ee koje bi moglo na\u0161tetiti interesima CHM Work Base. Do naru\u0161avanja interesa CHM Work Base dolazi posebno kada se kr\u0161e zakonski propisi.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Sljede\u0107e je nedopustivo posebno, ali ne isklju\u010divo:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Preuzimanje, nu\u0111enje, distribucija ili pohranjivanje sadr\u017eaja koji kr\u0161i osobna prava, autorska prava, zakon o za\u0161titi podataka ili kazneno pravo;\u00a0<ul><li>Preuzimanje, nu\u0111enje, distribucija ili pohranjivanje ra\u010dunalnih virusa ili drugog zlonamjernog softvera, kao i druge aktivnosti usmjerene protiv sigurnosti IT sustava (npr. hakiranje, skeniranje portova);\u00a0<\/li><\/ul>\n<ul class=\"wp-block-list\">\n<li>Pristup sadr\u017eaju koji podlije\u017ee naplati za CHM radnu bazu.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">8. Zavr\u0161ne odredbe &nbsp;<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Svaka izmjena ili dopuna ovih ugovora mora biti u pisanom obliku, pri \u010demu je dovoljna e-po\u0161ta. To se odnosi i na svako odricanje od zahtjeva za pisani oblik.\u00a0<\/li>\n\n\n\n<li>Ovaj ugovorni odnos reguliran je isklju\u010divo njema\u010dkim pravom. Ludwigshafen am Rhein je dogovoren kao isklju\u010divo mjesto nadle\u017enosti.\u00a0<\/li>\n\n\n\n<li>Ukoliko bilo koja odredba ovog ugovora bude ili postane neva\u017ee\u0107a ili neprovediva iz bilo kojeg razloga, to ne\u0107e utjecati na valjanost preostalih odredbi. Isto vrijedi i ako se poka\u017ee da<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Ugovor sadr\u017ei prazninu u svojim odredbama.
